Health Guarantee
Seller has made every effort to ensure that the puppy is healthy at the time Seller releases the puppy to the Buyer. Every puppy is examined by a licensed veterinarian prior to leaving and has passed an initial health exam, free from any illness and eating hard kibble. In order to validate our health guarantee, Buyer MUST have the puppy examined by a licensed vet within 48 hours of receiving the puppy and must obtain a signed document stating the puppy was examined within the required time frame as well as maintain required immunizations and medical treatment. Failure to do so will void this health guarantee. Should the Buyers vet find a life-threatening illness upon initial examination Buyer will forward all documentation to Seller to be reviewed by our vet. If Sellers vet concurs, then Buyer will be eligible for a full refund. In order to receive the refund, Buyer will need to immediately return the puppy and provide written documentation from a licensed vet stating the nature of the illness. If Buyer chooses to keep the puppy, then Buyer accepts all financial responsibility, and the Seller is not obligated to cover any veterinarian treatment.
This health guarantee does not cover dehydration, diarrhea, hypoglycemia, coccidia, kennel cough, internal or external parasites, giardia, fungal infections or any other non-life-threatening illness.
If the Buyer complies with all of the terms contained within this agreement, the Seller warrants the health of the puppy for the first year of life against genetic, hereditary, life-threatening genetic defects involving the heart, liver and kidneys. If during this first year a replacement puppy is deemed necessary due to an identified genetic life-threatening defect, the replacement puppy will be of equal or lesser value of puppy, unless Buyer prefers to pay the difference for a more valuable puppy. Buyer must return the puppy along with all registration papers and immunization records. In the unlikely event that a death occurs, a necropsy must be performed by a licensed vet and a copy must be forwarded to Seller for Sellers vet to review before determining if a replacement is to be made. If Sellers vet concurs then Seller will replace the puppy. All expenses are at Buyers expense including the licensed vet tests, professional diagnosis and necropsy, if applicable, as well as the return shipping and the shipping of the replacement puppy. If the puppy becomes ill and the owner has the puppy euthanized without prior consent from the Seller, no replacement will be made.
Seller cannot, and does not, guarantee breeding abilities, size, coat color, coat quality, shedding, length, weight, hernias of any kind, physical flaws, testicles descending, retained teeth, under or overbite, personality, ear standing, potty training ability or temperament of the puppy. Seller cannot guarantee that dewclaws will not regrow and will not be responsible for any vet charges associated with their removal.
Buyer agrees that the puppy will never be sold, leased or given to any pet shop, animal shelter, research laboratory or other similar facility. In the event Buyer decides they can no longer care for the puppy, wishes to sell or transfer ownership, the Buyer agrees to notify Seller immediately. The Seller is to be given the first chance at buying the puppy back at 1⁄2 the purchase price. All registration papers, immunization papers, etc. are to be returned with the puppy. The Buyer agrees to provide a life-long commitment, comfortable environment, prompt medical attention, proper grooming and responsible care.
If for any reason, there is an issue, Buyer agrees to discuss the issue privately with the Seller. Both parties agree to not post any derogatory comments on any form of social media or online platform.
THIS DOCUMENT IS A LEGALLY BINDING DOCUMENT. ANY COURT COSTS AND ATTORNEY FEES NECESSARY TO ENFORCE THIS CONTRACT SHALL BE PAID BY BUYER IN THE STATE OF GEORGIA AND THE LAWS OF THE STATE OF GEORGIA, COUNTRY OF UNITED STATES OF AMERICA, WILL GOVERN THE INTERPRETATION OF THIS CONTRACT. THIS GUARANTEE APPLIES TO THE ORIGINAL BUYER ONLY AND IS NOT TRANSFERABLE. THERE ARE NO OTHER WARRANTIES, EXPRESSED OR IMPLIED EXCEPT AS CONTAINED HEREIN.
I, the Buyer of a puppy from The Luckie Puppy, hereby acknowledge that I have received a copy of this document that is three pages long. Further, I accept all terms and conditions of the guarantee for congenital or hereditary disorders contained herein and I waive and relinquish any other rights that I might otherwise have in the event of such occurrence. Buyer acknowledges by signing below, that he or she has read, understands and agrees to the terms of this agreement in its entirety.
